1. Acceptance of Terms
By accessing or using ClassRep ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including education centre owners, administrators, teachers, and parent portal users.
2. Description of Service
ClassRep provides a cloud-based management platform for private education centres in Malaysia. The Service includes tools for student management, class scheduling, attendance tracking, invoice generation, payment collection via FPX (Billplz), progress report generation, and parent portal access. Features may be added, modified, or discontinued at any time.
3. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at support@ClassRep.my if you suspect any unauthorised use of your account.
4. Subscription and Payment
ClassRep is offered on a monthly subscription basis. Fees are charged in Malaysian Ringgit (RM) and are non-refundable except where required by Malaysian law. Your subscription renews automatically each month unless cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Prices may be updated with 30 days' written notice.
5. Data and Privacy
You retain ownership of all data you input into ClassRep, including student records, attendance data, and payment records. We process this data solely to provide the Service. By using ClassRep, you confirm that you have obtained appropriate consent from students and parents to collect and store their personal data in accordance with the Personal Data Protection Act (PDPA) 2010. 6. Prohibited Uses
You may not: (a) use the Service for any unlawful purpose or in violation of any Malaysian law; (b) share your account credentials with unauthorised parties; (c) attempt to gain unauthorised access to any part of the Service or its underlying infrastructure; (d) use the Service to send unsolicited communications; (e) reverse engineer, decompile, or attempt to extract source code from the Service.
7. Intellectual Property
All intellectual property rights in the Service — including software, design, trademarks, and content — belong to ClassRep. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your internal business purposes. This licence does not include any rights to reproduce, modify, or distribute the Service or its components.
8. Limitation of Liability
To the maximum extent permitted by Malaysian law, ClassRep shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability to you for any claim arising from these Terms or the use of the Service shall not exceed the amount you paid us in the three months preceding the claim.
9. Service Availability
We aim to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. We are not liable for any losses resulting from downtime, data delays, or interruptions outside our reasonable control.
10. Termination
Either party may terminate this agreement at any time. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, you may export your data within 30 days. After that period, your data may be permanently deleted. Clauses relating to intellectual property, limitation of liability, and governing law survive termination.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Malaysia. If any provision of these Terms is held to be unenforceable, the remaining provisions shall continue in full force.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or via an in-app notice at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
